10 Defendants in Tukin ESDM Mark Up Case Rp. 27 Billion Sentenced to 2 to 6 Years in Prison

KPK prosecutors are demanding prison sentences for 10 employees of the Ministry of Energy and Mineral Resources. Prosecutors believe that the 10 ESDM employees were proven guilty of corruption in cutting performance allowances (tukin) at the Ministry of Energy and Mineral Resources which caused state financial losses of IDR 27 billion.
“Declaring that the defendants have been proven legally and convincingly according to the law to be guilty of committing criminal acts of corruption as regulated and punishable by crime in Article 3 in conjunction with Article 18 of the Corruption Law in conjunction with Article 55 paragraph 1 to 1 of the Criminal Code in conjunction with Article 64 paragraph 1 of the Criminal Code as the second alternative indictment, ” said the KPK prosecutor when reading the letter of indictment at the Jakarta Corruption Court, Thursday (29/2/2024).

The defendants are Abdullah as Expenditure Treasurer at the Directorate General of Mineral and Coal, Ministry of Energy and Mineral Resources, FY 2020-2021 (defendant I); Christa Handayani Pangaribowo as Assistant Expenditure Treasurer at the Directorate General of Mineral and Coal, Ministry of Energy and Mineral Resources FY 2020-2021 and Treasurer of Expenditures at the Directorate General of Mineral and Coal, Ministry of ESDM FY 2022 (defendant II); Rokhmat Annashikhah as Employee Expenditure Administration Management Officer (PPABP), Payment Order Application Operator and Bill Examiner at the Secretariat of the Directorate General of Mineral and Coal, Ministry of Energy and Mineral Resources, FY 2020-2022 (defendant III).

Commitment Making Officer (PPK) Novian Hari Subagyo (defendant VIII); PPK staff Leinhard Febrian Sirait (defendant IX); and Treasury Subdivision/PPSPM Priyo Andi Gularso (defendant X).

The following are the prison sentences demanded for the 10 defendants:

– Abdullah was sentenced to 2 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Abdullah was also required to pay compensation amounting to IDR 355,486,628 subsidiary to 1 year in prison.
– Christa was sentenced to 3 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Christa was also required to pay compensation amounting to IDR 2,592,482,167 subsidiary to 2 years in prison.
– Rokhmat was sentenced to 2 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Rokhmat was also required to pay compensation in the amount of IDR 1,254,014,825 subsidiary to 1 year in prison.
– Beni was sentenced to prison for 3 years and a fine of IDR 300 million subsidiary to six months in prison. Beni was also required to pay compensation amounting to IDR 1,629,875,090 subsidiary to 2 years in prison.
– Hendi was sentenced to 2 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Hendi was also required to pay compensation amounting to Rp. 679,944,468 subsidiary to 1 year in prison.
– Haryat was sentenced to prison for 2 years and a fine of IDR 300 million subsidiary to 6 months in prison. Haryat was also required to pay compensation amounting to IDR 963,532,375 subsidiary to 1 year in prison.
– Maria Febri was sentenced to 2 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Maria was also required to pay compensation amounting to IDR 805,789,121 subsidiary to 1 year in prison.
– Novian was sentenced to 3 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Novian was also required to pay compensation amounting to IDR 1,043,268,176 subsidiary to 2 years in prison.
– Leinhard was sentenced to 6 years in prison and a fine of IDR 300 million subsidiary to 6 months in prison. Leinhard was also required to pay compensation amounting to IDR 12,437,968,375 subsidiary to 4 years in prison
– Priyo was sentenced to prison for 5 years and a fine of IDR 300 million subsidiary to 6 months in prison. He was also required to pay compensation amounting to IDR 5,584,066,929 subsidiary to 2 years in prison.

The prosecutor said that the burden of the charges was that the defendants’ actions did not support the government’s program to eradicate corruption. While the circumstances mitigate the demands of the defendants, they must be honest about their actions, polite and respectful of the trial and have never been convicted.
